Not Enough!

    Our current laws regarding wife and child abuse are not definitive—not enough! Recently I rented the movie Enough again. A relative had not seen it and we are on an action flick kick at the moment. Of course, watching the film a second time was no great sacrifice, I am sure the reason is obvious to many people. Enough will probably never become a classic, unless in some didactic sense such as is Conrack, but it is an important film at present because it deals with an important issue: wife abuse. Farrah Fawcett starred in The Burning Bed, also about wife abuse, twenty years ago. Wife and child abuse are issues that really get me into high gear, if you will, so here we go.


   Wife abuse is not only physical, of course, but it is the physical abuse that I want to discuss mainly. I also know that husband/spousal abuse occurs, but I want to talk about wife abuse only. The movie gives us a general view of wife abuse. As a regular reader of crime books written by Ann Rule et al, I also have other perspectives. Not all of Rule’s cases involve wife abuse, predictably, but some do and they are cases from which we can learn much.


   The biggest problem, as we see in the movie, is prevention; not only of wife abuse, but sometimes of murder(spousal/ex spousal). Some of us have heard about similar cases or even witnessed true cases. Slim, the abused wife in Enough, sort of takes matters into her own hands because the “help” that the law or police can provide is ambiguous, let us say. Ambiguous because, in general, police cannot arrest a person who harbors an intent or wish to commit a crime. The police must wait until the crime has been committed. But why? I ask. If this delay is a matter of law and/or free speech, these can be changed. Freedom of expression should be sacred as it has been for so many years in our country and some other fortunate countries. However, freedom to truly threaten the life of a fellow citizen should not be sacred. Of course, if there is a real-life scene in which only the abuser and victim are present, not a lot can be done. We have one person’s word against another’s. In the case in which there are witnesses, however, steps can and should be taken by authorities. Cases in which a husband angrily threatens his wife's life in front of witnesses(who are able or old enough to testify) should be dealt with severely and in a manner that relays a clear societal message to that husband. By severely I mean jail time and some sort of fine for the first reported offense. Both measures, not just one; and certainly not just a “day in jail” type of action. Hitting the abuser both in his wallet and in his free time(say, weekends) should make a difference. If the abuser is clearly determined not to let up, as was the real-life case of our friendly, black-hearted bastard Allen Van Houte Blackthorne(Every Breath You Take), not a lot, again, can be done. Question: If Blackthorne had been charged once or twice with threatening his wife, later ex wife, Sheila, based on testimonies(and there were plenty of witnesses), and had been both sent to jail and fined(a nice stiff one, let us say, ten thousand dollars for each offense), would he then have lost interest in seeing Sheila dead(as in murdered, the mom of his offspring!)? His adopted last name, Blackthorne, was certainly fitting for a thorn pricks and black, of course, has its traditional negative connotations(color of costumes, etc., not people). Speaking of the devil...


   For me, then, jail time and fines are and should be available to law enforcement personnel as preventive measures regarding wife abuse. Hit the abuser and would-be murderer where it hurts most and maybe, with a bit of luck thrown in, just maybe, some lives can be saved in the future.

  

Judge: Okay, Mr Doe. We have witnesses who have sworn that you have
             threatened your wife’s life. That’s 30 days in jail and a $900 fine,
             payable immediately. If you don’t have the money, the sale of
             your automobile must take place...

Doe: It’s a lie, your Honor, a frameup. They’re out to get me. Her
             family hates me.

Judge: Oh really? It just happens that two of the witnesses are some of
             your own relatives. What do you say to that?
